On May 18, 1965, the Senate passed S. 306 by a voice vote without debate. On September 24, the House passed an amended S. 306 by a vote of 294 to 4. On September 29, Acting Secretary of HEW, Wilbur Cohen, wrote Muskie of the administration’s preference for the House-passed bill that provided the Secretary of HEW more flexibility in establishing standards regulating automobile emissions and on the timeline for implementation. Cohen assured Muskie of the administration’s plans “to pursue a vigorous program under the abatement provisions of the Clean Air Act.” On October 1, the Senate concurred in the House amendments to S. 306 by a voice vote and on October 20, President Johnson signed the bill into law.

In the House of Representatives, Representative Dante B. Fascell (D-FL) introduced H.R. 6927 that created a Department of Housing and Urban Development. Representative William L. Dawson (D-IL), chair of the House Committee on Government Operations, enlisted the support of Richard J. Daley, the powerful mayor of Chicago and a former president of the United States Conference of Mayors. In this April 5, 1965 transcript of hearings before the Executive and Legislative Reorganization Subcommittee of the House Committee on Government Operations, Mayor Daley underscored the need for the new department by forcefully declaring that the nation needs to “recognize the obvious—that we live in an urban society…”

Chairman Dawson convened an executive session of the full committee on May 5, 1965 to vote on H.R. 6927 and report the bill to the House. He stated that the legislation simply upgraded the existing Housing and Home Finance Agency (HHFA) to cabinet-level status and gave the new secretary the power to coordinate and administer urban programs. Representative William S. Moorhead (D-PA) , however, voiced concerned that the bill “is creating a skeleton” that will grow and seek new powers. When the roll call vote was taken, however, Moorhead and 20 others voted to report the bill favorably while 8 voted against reporting the bill.

S. 3 moved through the House of Representatives quickly. It was reported by the House Committee on Public Works, chaired by George H. Fallon (D-MD), on February 17, 1965. On February 26, 1965, Fallon sent this telegram to North Carolina Governor Dan K. Moore urging him “to take immediate action” to line up congressional support for the bill. Similar telegrams were sent to all the other Appalachian state governors. S. 3 passed the House on a 257 to 165 roll call vote on March 3 and was the first significant Great Society legislation to pass the Eighty-ninth Congress. On March 9, President Johnson signed into law the Appalachia Regional Development Act of 1965.

On January 13, 1965, Representative Emanuel Celler (D-NY) introduced in the House of Representatives an administration-backed immigration bill, H.R. 2580. On March 3, the Subcommittee on Immigration and Nationality, chaired by Representative Michael A. Feighan (D-OH), opened hearings with these remarks of Attorney General Nicholas deB. Katzenbach. He stated that a “prompt remedy” to the current immigration system was necessary for three reasons. “Elemental humanity” required eliminating a system separating families. “Domestic self-interest” required removing barriers that prevented “brilliant and skilled residents of other countries” from working in the United States. Finally, “self-interest abroad” required ending immigration restrictions that discriminated against countries in Southern and Eastern Europe and Asia.

Broad, bipartisan support for voting rights was signaled by the 66 Senators who were eager to sign as sponsors of an administration-backed bill that had been quietly negotiated with Senate leaders. When introduced on March 18, 1965, 46 Democrats and 20 Republicans had signed as sponsors of the bill. This sponsor sheet was attached to a typed bill, stamped “Mar 18 1965” with a pencil mark “1564” assigning the bill a number. Instructions to “Return To the Senate Bill Clerk” indicate that these documents would be sent to the Secretary of the Senate’s office to be printed as a Senate bill.

An education bill identical to the one the House passed was introduced in the Senate. Democratic leaders were determined to pass the bill, S. 370, without amendments in order to avoid either House reconsideration or a conference committee. When the Labor and Public Welfare Committee reported S. 370 unanimously and without amendments, the fight shifted to the Senate floor. Two days after the bill was reported from the committee, Lister Hill (D-AL), chair of the Labor and Public Welfare Committee, received this letter from Jacob K. Javits (R-NY) stating that he would introduce an amendment changing the funding formula. After Javit’s amendment was defeated, the Senate passed the bill by a vote of 73 to 18, and two days later President Johnson signed the Elementary and Secondary Education Act into law.

The subcommittee’s 1964 report declared that the technological skills and equipment to reduce air pollution had “passed the research stage” and that there was “no valid reason to delay” adoption of emissions control equipment in newly manufactured automobiles. As this Schedule of Events for April 7, 1965 indicates, the subcommittee traveled to Detroit to hear from automobile manufacturers and to visit Chrysler, General Motors, and Ford research facilities.

President Dwight D. Eisenhower’s health problems and President John F. Kennedy’s assassination heightened support for a constitutional amendment to address the exercise of presidential power in the event of presidential disability and to provide a process for filling a vacancy in the vice presidency. S.J. Res 1 was introduced on January 6, 1965 by Senator Birch Bayh (D-IN), chair of the Subcommittee on Constitutional Amendments of the Senate Judiciary Committee. It was similar to a resolution that had passed the Senate on September 29, 1964. Bayh introduced the resolution while he continued to gather co-sponsors, who are indicated by a check mark by their names on the attached Senate roster. The 1,530 copies of the resolution ordered printed included the names of those cosponsors.

On the first day of the subcommittee hearings, the Assistant Secretary of Health, Education, and Welfare (HEW), James M. Quigley, made comments that seemed to place the administration at odds with Muskie and S. 306. Quigley declared that the proposed controls were premature, that current federal authority was adequate, and that “we do not recommend enactment of regulatory legislation at this time….” This letter from S. Smith Griswold, California Air Pollution Control Officer, expressed his alarm over Quigley’s remarks and urged Muskie to push ahead with strong regulation. Quigley returned to the subcommittee hearings to clarify that he was only objecting to S. 306’s detailed standards and aggressive timeline to implement emission controls.
