For example, this resolution passed by the American Association of Thoracic Surgery on March 30, 1965 called for passage of legislation requiring emphatic health warnings on cigarette packages and in advertising that would lead the public to “an eventual understanding of this dangerous habit…”

An account of the resource
House passage of H.R. 3014 provoked strong opposition from health organizations and liberal advocacy groups. On June 24, 1965, Americans for Democratic Action issued this press release stating that the Senate-passed bill “is at least tolerable,” but urged President Johnson to veto the legislation if the House version permanently barring the Federal Trade Commission (FTC) action on health warning in advertising remained in the bill. A conference committee resolved the Senate and House differences on the moratorium by providing a four-year ban on FTC action. On July 6, the Senate adopted the conference report by a voice vote and on July 13, the House adopted the report by a 286 to 103 roll call vote. On July 27 President Johnson signed the bill into law without comment.

When H.R. 3708 was introduced in the Senate, it was referred to the Senate Committee on Labor and Public Welfare, chaired by Lister Hill (D-AL). Anthony Celebrezze, Secretary of the Department of Health, Education and Welfare (HEW), responded to the chair’s request for a report on the bill and supported its provisions with one exception. Celebrezze objected to a provision of H.R. 3708 that had been added to the bill by a floor amendment and that gave states the final say on certain grants awarded by HEW to state agencies or to public or private nonprofits serving the elderly. The Senate committee reported a bill conforming to the administration request and on June 16, the Senate passed H.R. 3708 by a roll call vote of 72 to 5. On July 6, 1965, the House agreed to the Senate’s version of H.R. 3708 leaving the final decision on grants to HEW.

In May 13, 1965, the Federal Trade Commission (FTC) Chairman Paul Rand Dixon wrote Senator Warren G. Magnuson to restate the position of the agency that warnings in cigarette advertising, not just labels on packages, would more fully inform the public of the hazards of cigarette smoking and to re-assert that the public interest would be served “if the Commission is left free by the Congress to take action…” While Dixon continued to resist Congress’s pre-emption of FTC regulatory action, he supported amendments to S. 559 providing for a three-year moratorium on FTC regulation while more information about “the health consequences of smoking” was obtained.

S. 3 moved through the House of Representatives quickly. It was reported by the House Committee on Public Works, chaired by George H. Fallon (D-MD), on February 17, 1965. On February 26, 1965, Fallon sent this telegram to North Carolina Governor Dan K. Moore urging him “to take immediate action” to line up congressional support for the bill. Similar telegrams were sent to all the other Appalachian state governors. S. 3 passed the House on a 257 to 165 roll call vote on March 3 and was the first significant Great Society legislation to pass the Eighty-ninth Congress. On March 9, President Johnson signed into law the Appalachia Regional Development Act of 1965.

An education bill identical to the one the House passed was introduced in the Senate. Democratic leaders were determined to pass the bill, S. 370, without amendments in order to avoid either House reconsideration or a conference committee. When the Labor and Public Welfare Committee reported S. 370 unanimously and without amendments, the fight shifted to the Senate floor. Two days after the bill was reported from the committee, Lister Hill (D-AL), chair of the Labor and Public Welfare Committee, received this letter from Jacob K. Javits (R-NY) stating that he would introduce an amendment changing the funding formula. After Javit’s amendment was defeated, the Senate passed the bill by a vote of 73 to 18, and two days later President Johnson signed the Elementary and Secondary Education Act into law.

Description

While there was strong support for a new department from city residents, urban political leaders, and housing advocacy organizations, rural America was less receptive. This letter from John C. Lynn, Legislative Director of the American Farm Bureau Federation to Chairman Dawson questions the need for the department and voiced a “major concern” that the federal government “is going to perform a much larger role” in planning and financing urban development. The Farm Bureau was alarmed by Robert C. Weaver, Administrator of the Housing and Home Finance Agency, who had called for “a comprehensive program of federal responsibility” concerning urban development. Later in the year, Weaver became the first secretary of the new department and the first African-American to hold a cabinet-level position.

On June 14, 1965, the House Democratic leadership rallied the majority to “support the President” and to fulfill “a specific pledge of the Democratic Platforms both in 1960 and 1964” by voting for H.R. 6927. They warned that the bill’s opponents’ claims that the transfer of the Federal Housing Administration (FHA) was a “downgrading” of that agency were bogus and that failure to transfer the agency would “hamstring” the new department. When Representative John N. Erlenborn (R-IL) offered an amendment deleting the transfer of FHA to the department, it was easily defeated. On June 16, the House passed the bill by a vote of 217 to 184 and on August 11, the Senate passed H.R. 6927 by a vote of 57 to 33. When President Johnson signed the bill into law on September 9, the Department of Housing and Urban Development became the first cabinet-level department established since the Department of Health, Education and Welfare was created in 1953.

An account of the resource
On January 12, 1965, President Lyndon B. Johnson sent Congress a forceful education message proposing “that we declare a national goal of Full Educational Opportunity.” Further, he asserted, “Every child must be encouraged to get as much education as he has the ability to take.” Johnson’s message tried to side step opposition to funding private, parochial schools by basing federal support on the number of children from low-income families. To blunt fear of federal involvement in local schools, the administration called for funds to be distributed by grants to states and provided that local districts have wide discretion on the use of funds.

In this press release of January 7, 1965, President Lyndon B. Johnson declared that “this year is the year when… Congress should enact a hospital insurance program for the aged” and outlined major features of the program. Representative Cecil King (D-CA) and Senator Clinton Anderson (D-NM) introduced identical administration-backed bills, H.R. 1 and S. 1, that gave the president everything he requested. The bills also gave liberal Democrats what they had fought for in Congress for years: hospital care for persons 65 and older financed by an increase in the Social Security payroll tax.
