On January 12, 1965, President Lyndon B. Johnson sent Congress a forceful education message proposing “that we declare a national goal of Full Educational Opportunity.” Further, he asserted, “Every child must be encouraged to get as much education as he has the ability to take.” Johnson’s message tried to side step opposition to funding private, parochial schools by basing federal support on the number of children from low-income families. To blunt fear of federal involvement in local schools, the administration called for funds to be distributed by grants to states and provided that local districts have wide discretion on the use of funds.

On January 12, 1965, Carl D. Perkins (D-KY), chair of the General Education Subcommittee of the House Committee on Education and Labor, introduced H.R. 2362, an administration backed education bill. It specified a federal funding formula based on half of a state’s expenditure per pupil times the number of children from families with an annual income below $2,000. This chart is an initial estimate of how education funds would be allocated by state and by program and was carefully studied by the subcommittee. The subcommittee reported the bill with the funding mechanism intact, and the full committee, despite much criticism of the funding formula, retained it when it voted 23 to 8 to report the bill on March 2, 1965.

H.R. 2362 was backed by a fragile coalition of leading education organizations and religious leaders. The bill provided enough support to private schools to enlist the support of Catholic groups, but not so much as to arouse opposition from Protestant and Jewish groups and public teachers’ organizations. While Catholics supported the bill, they threatened opposition if it included a provision specifically permitting a constitutional challenge grounded in opposition to state support of religion. When the bill was debated on the House floor, Representative Howard W. Smith (D-V), an opponent of the bill, offered this hand-written amendment aimed at alienating Catholic support, but the amendment failed by a voice vote. On March 26, 1965, by a 263 to 153 roll-call vote, the House passed H.R. 2362 and sent it to the Senate.

An education bill identical to the one the House passed was introduced in the Senate. Democratic leaders were determined to pass the bill, S. 370, without amendments in order to avoid either House reconsideration or a conference committee. When the Labor and Public Welfare Committee reported S. 370 unanimously and without amendments, the fight shifted to the Senate floor. Two days after the bill was reported from the committee, Lister Hill (D-AL), chair of the Labor and Public Welfare Committee, received this letter from Jacob K. Javits (R-NY) stating that he would introduce an amendment changing the funding formula. After Javit’s amendment was defeated, the Senate passed the bill by a vote of 73 to 18, and two days later President Johnson signed the Elementary and Secondary Education Act into law.

President Dwight D. Eisenhower’s health problems and President John F. Kennedy’s assassination heightened support for a constitutional amendment to address the exercise of presidential power in the event of presidential disability and to provide a process for filling a vacancy in the vice presidency. S.J. Res 1 was introduced on January 6, 1965 by Senator Birch Bayh (D-IN), chair of the Subcommittee on Constitutional Amendments of the Senate Judiciary Committee. It was similar to a resolution that had passed the Senate on September 29, 1964. Bayh introduced the resolution while he continued to gather co-sponsors, who are indicated by a check mark by their names on the attached Senate roster. The 1,530 copies of the resolution ordered printed included the names of those cosponsors.

Representative Emanuel Celler sponsored H. J. Res. 1, a companion to the resolution passed by the Senate, and reported it from the House Judiciary Committee on March 24, 1965. This engrossing copy of the resolution passed in the House on April 13, 1965 by a vote of 368 to 29.The major difference between the resolutions hinged on whether a time limit would be imposed on Congress’s decision to resolve a disagreement between the president, the vice president, and the cabinet concerning the former’s ability to serve. The conference committee resolved the difference in favor of the House insistence on a twenty-one day requirement for a congressional decision.

After the House agreed to the conference report on June 30, 1965 and the Senate agreed on July 6, the resolution was sent to the General Services Administration for transmittal to the states. On July 9, 1965, Senator John Stennis (D-MS), a senior, highly esteemed member of the Senate, sent the young Senator Bayh a note of congratulation commending him for “the splendid way you carried this entire matter.” Ratification was completed on February 10, 1967 when Nevada became the thirty-eighth state to approve the proposed amendment.

In the spring of 1964, President Johnson sent a request to Congress to authorize special aid to the economically depressed Appalachian region, and on September 25, 1964, the Senate passed an Appalachia bill that closely followed the president’s request. It provided $1.1 billion to the region over a six year period, but a companion House bill failed to reach the floor prior to the adjournment of the 88th Congress. On January 6, 1965, Senator Jennings Randolph (D-WV), chair of the Subcommittee on Public Roads of the Senate Committee on Public Works, introduced an administration backed Appalachia aid bill, S. 3, calling for $1.07 billion in federal economic assistance to the region.

On January 21, 1965, Senate Majority Leader Mike Mansfield (D-MT) wrote Senator Randolph Jennings (D-WV) urging him to make “a special effort” to complete the subcommittee hearings and report S. 3 to the full committee chaired by Senator Pat McNamara (D-MI). Both Jennings and McNamara heeded Mansfield’s request to help him “get the floor work underway as soon as possible.” The Public Works Committee reported the bill on January 27, 1965 and on February 1, 1965, the Senate passed S. 3 by a 62 to 22 vote.

An account of the resource
S. 3 moved through the House of Representatives quickly. It was reported by the House Committee on Public Works, chaired by George H. Fallon (D-MD), on February 17, 1965. On February 26, 1965, Fallon sent this telegram to North Carolina Governor Dan K. Moore urging him “to take immediate action” to line up congressional support for the bill. Similar telegrams were sent to all the other Appalachian state governors. S. 3 passed the House on a 257 to 165 roll call vote on March 3 and was the first significant Great Society legislation to pass the Eighty-ninth Congress. On March 9, President Johnson signed into law the Appalachia Regional Development Act of 1965.
